1. ACCEPTANCE AND AVAILABILITY

These Conditions regulate the legal relationship derived from the purchase processes formalized by the Users through the website of Z3 LIVE COMMERCE.

Users expressly accept full and unreserved adherence to these stipulations, in the version published by Z3 LIVE COMMERCE at the time the User contracts the product in which he is interested. Therefore, the User undertakes to carefully read the contracting conditions, each time he proceeds to contract a product, since they have been subject to modification since the last time he accessed.

2. NATURE OF THE CONTRACT

Through this contract, Z3 LIVE COMMERCE sells to the client (any natural or legal person with whom Z3 LIVE COMMERCE signs any contract for the sale of its website) and he buys the product specified in the invoice / delivery note / order from Z3 LIVE COMMERCE. By “contract” is understood the sale and purchase transaction that is implemented through this document. The term “product” is understood to be the merchandise that is the object of purchase.

3. PRICE

The prices of our products are expressed in euros and exclude the corresponding Value Added Tax (VAT) and ecotax.
Z3 LIVE COMMERCE reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time the order is registered.
We do not assume responsibility for any typographical or arithmetic error that may appear on the page.

4. STOCKS AVAILABILITY

Our offers and prices are valid as long as they are displayed on the website, and always based on available stocks.

We have items with variable stock availability indicated in the Product Sheet.

We normally only offer products that we have in stock. For products that are not in our warehouses, our offers are valid on the condition that there is availability from our suppliers.

Within this framework, indications will be provided on the availability of the products at the time each order is processed.

In the event that the product is not available after the processing of an order, the buyer will be informed by email or by telephone of the delivery of only a part of his order, being able to accept or cancel the order. In any case, the client will receive a partial or full refund within a maximum period of 72 hours.

5. PAYMENT, MAXIMUM SECURITY

The payment of the product can be made online with VISA, MASTERCARD, credit card and through bank transfer, according to the following conditions:

The moment you press the “ACCEPT” button during the order confirmation, the bank verifies the validity of your credit card number and checks that it is not blocked.
Z3 LIVE COMMERCE will deliver the corresponding invoice to the client when he so requests when filling in the contracting data. This invoice will be sent to you by email, or it can be downloaded online in the customer area. The charge to the credit card will be made at the time of purchase.

Randomly, to reinforce security and to verify the reliability of the data provided when placing an order, the company may request additional data from the customer (such as a copy of the ID or proof of address less than three months old) that allow verifying that the purchase has been made by the cardholder. The document must be sent within a period of five business days, with Z3 LIVE COMMERCE reserving the right to reimburse said order if it does not receive the requested documents or if they are not valid.

Likewise, Z3 LIVE COMMERCE reserves the right to cancel or reject any order from a client with whom it has a dispute regarding the payment of a previous order.

In the case of international transfer (if proof of payment is not sent by fax or email, the shipment may be delayed for a few days):

NOTICE: At the time of payment, do not forget to indicate the reference that we will provide you with your order, it is essential to be able to identify your payment.

The order will not be considered confirmed until you send the receipt of the scanned transfer to our email, and it is verified that our bank has made the deposit.

Possible exchange and banking commissions are borne by the client.

6. DELIVERY TERMS AND COSTS

The products are sent to the address indicated by the customer when placing the order. In order to optimize delivery, we invite the buyer to indicate an address where the order can be delivered on weekdays from 8:30 a.m. to 7:00 p.m.

It is recommended that the User provide us with a mobile phone so that the carrier can locate it in addition to indicating the particularity that is required.

The product delivery costs are included in the price for minimum orders that depend on the product, and the terms are:

For shipments:

  • Shipments will be delivered within 48 hours provided it is available in stock except Saturdays, Sundays, and holidays.
  • No deliveries are made on Saturdays, Sundays, and holidays, unless expressly requested and prior agreement of extra expenses.
  • All shipments are adequately protected and packaged to ensure that the product arrives in perfect condition.

 

In the event that the carrier tries to deliver the package and there is no one to receive it, it will leave a note stating the delivery attempt. Please contact the transport agency as soon as possible through the telephone number that you will find in the note, in order to arrange a new delivery.

If in this second delivery there is no one to receive it, you will leave a note again stating the second delivery attempt. Thereafter, your order will remain in the office of the transport agency for 15 days. After these days have elapsed, your order will be returned to our warehouse.

By the time you receive your package, you must:

  • Check the conformity of the merchandise received at the time of delivery.
  • Point out any anomaly on the delivery note, stating your reservations and including your signature.

 

Z3 LIVE COMMERCE does not assume any responsibility for the consequences of possible delays in shipment.

7. CANCELLATIONS AND RETURNS

Orders can be canceled free of charge until the moment the shipment becomes effective. If we receive notice of cancellation once the package has already been sent, it will be considered a return. Returns can be made up to 7 calendar days from receipt of the product according to the specifications that follow.

The right of return may not be exercised when there are indications that the products have been opened, manipulated, or exposed to inappropriate conditions. It is mandatory to return properly protected products, in their original packaging, in perfect condition for later sale.

Any package that lacks any of the sender’s identification elements (name, surname, address, order number) cannot be accepted. The return of the ordered products will give rise to the refund of the totality of the amounts paid by the User.

Shipping costs are borne by the customer, as well as return costs.

Returns that are derived from our error or from a product defect are excluded from this case. In this case, Z3 LIVE COMMERCE undertakes to exchange the defective product for another equal one or the amount will be refunded. You will also take care of the return and subsequent shipping costs. We will not accept any exchange or return if we have not previously received any notification.

8. RIGHTS AND OBLIGATIONS OF THE PARTIES

Make a copy of the text of the general conditions available to the User.

b. Obligations of the User

For his part, the User agrees to:

Carry out full compliance with the provisions of these conditions of the services provided by Z3 LIVE COMMERCE, complete the registration forms prior to the start of the contracting procedure with accurate and current information.

Providing, correctly, the bank details requested by Z3 LIVE COMMERCE, paying the price of the products purchased, without submitting a claim exempting you from this obligation.

c. User Rights:

All information provided to the client will be binding on the offeror under the terms established by current legislation.

Every User has the right that the goods they acquire are of the category and legal requirements contracted or of that quality that is directly proportional to the category of the establishment.

9. PERIOD OF VALIDITY OF THE PRESENT CONDITIONS

The period of validity of these conditions will be the time they remain published on the website and will be applied to the services purchased at the time these conditions were available.

In any case, Z3 LIVE COMMERCE reserves the right to modify them unilaterally, without this affecting the services contracted by users prior to the modification, except in those cases in which the user has changed or modified the contracted service, in which case the conditions in force at the time of the change and / or modification will apply.

10. NULLITY AND INEFFECTIVENESS OF THE CLAUSES

17. COMPANY VERIFICATION

Once Z3 LIVE COMMERCE receives suggestions for companies that want to collaborate with us, we do our due diligence and put them through a thorough verification process in order to authenticate their legitimacy.

The process includes but is not limited to the following:

  • Certificate of incorporation. This is to prove that the company has been legally registered.
  • VAT number. We check through the relevant tax authorities to prove existence and validity of the VAT number provided.
  • Control of creditworthines. We verify on 5 different credit rating softwares if our potential partners are not too indebted.
  • Identification of the representative. Z3 requires a copy of the National ID or Passport of the company’s director or representative. This should match the name on the corporate registration document.
  • Security of the website. The company needs to have an existing and secure website that has a web application firewall activated to prevent attacks and hacks. It should also follow website security best practices and has no configuration issues or known vulnerabilities such as viruses or any other malware.
  • Positive online presence. The company should have an active online status on social media platforms such as LinkedIn, Twitter, Facebook, Pinterest, and/or Instagram.
  • Contact details. Z3 LIVE COMMERCE requires the incoming company to provide a correct and active phone number and email address. This is then verified by calling the number and sending an email for confirmation. We also require an alternate phone number and email address. All these contact details should also appear on the company’s website.
  • Address. We check to verify whether the company has a physical address.

Once all the above checks out, the company is then confirmed and entered into a complex CRM software solution, CREDEMA.

18. WARRANTY

Customers have the guarantee offered by each of the different manufacturers of the items.
Damages caused by improper use or handling of the products are not included in the warranty.
